Colombia Yoga Adventure Sweepstakes

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN.

A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.

  1. WHO MAY ENTER: The Sweepstakes (as defined below) is open only to individuals who are legal residents of and physically located in one of the fifty (50) United States of America (including Washington, D.C. but excluding residents of any state that at the Sweepstakes Period requires registration and/or bonding of the Sweepstakes, including without limitation, New York and Florida (“Excluded States”)) or a province of Canada (other than Quebec) and who are at least 21 years of age or older at the time of entry. Residents of the Province of Quebec, Puerto Rico, Gaum, the U.S. Virgin Islands, the Mariana Islands, American Samoa, or Excluded States are NOT eligible. By entering the Sweepstakes and providing an email address and other contact information for any marketing materials from the Sweepstakes Entities (defined below), you are representing that you are a resident of the United States of America (other than of an Excluded States) or Canada (other than of Quebec). The Sweepstakes is not open to (a) any stakeholder, employee, officer, manager, agent, consultant or director of The Travel Yogi, Fathom, Eastern Mountain Sports or YogaWorks (hereinafter collectively, the “Sweepstakes Entities”), or any such person of a Sweepstakes Entity’s parent company, subsidiaries or affiliates, and any advertising, promotional or fulfillment agencies involved in the Sweepstakes, and (b) members of the household or immediate family of any such person. The Sweepstakes is void where prohibited or restricted by law, and is subject to all applicable federal, state, provincial, territorial, local and municipal laws and regulations, including without limitation those related to COVID-19 requirements and/or restrictions.
  2. SPONSOR: The “Sponsor” of this “Colombia Yoga Adventure” sweepstakes (the “Sweepstakes”) is The Travel Yogi, 3807 East 5th Street, Long Beach, CA 90814. Fathom, Eastern Mountain Sports and YogaWorks (collectively, the “Partners”) have either provided prizing or other promotional services for the Sweepstakes. The Travel Yogi maintains sole responsibility for operating the Sweepstakes.  Entrant’s (also referred to as “you”, “your” or “entrant”) registration and participation in the Sweepstakes shall be governed by the terms and conditions contained herein (the “Official Rules”). In no way is Instagram a sponsor of the Sweepstakes, and does not endorse or administer the Sweepstakes regardless of the Sponsor’s promotion of the Sweepstakes on Instagram.
  3. SWEEPSTAKES PERIOD: The Sweepstakes begins on September 1, 2022 at 9:00 A.M. PDT and ends on September 30, 2022 at 11:59pm PDT (the “Sweepstakes Period”). The Sponsor’s database computer is the official time-keeping device for this Sweepstakes.
  4. HOW TO ENTER: During the Sweepstakes Period you must navigate to https://thetravelyogi.wpengine.com/yoga-retreat-giveaway/ (to be updated) and submit the following:
  • Your first and last name
  • Your email address

You must also link to the Instagram account for The Travel Yogi, Fathom, Eastern Mountain Sports  and YogaWorks from the Sponsor’s website www.TheTravelYogi.com (the “Website”), and take action to “follow” each Instagram channel. You may only enter the Sweepstakes once; however, an additional entry will be automatically credited to each entrant that invites another person to enter, via email, when that person enters. There is no limit on the number of additional entries. Incorrect and incomplete entries are void. All entries must be received prior to the expiration of the Sweepstakes Period in order to be eligible. Any attempt by any entrant to enter by using multiple/different accounts, email addresses, identities, registrations and logins, or any other fraudulent methods will void that entrant’s entries and that entrant may be disqualified.  Use of any automated system to participate is prohibited and will result in disqualification.

  1. AGREEMENT TO OFFICIAL RULES: By entering the Sweepstakes, each entrant accepts and agrees to be bound by these Official Rules.  Furthermore, each entrant understands and acknowledges that he/she/they is/are providing information to the Sponsor, and agrees to accept the decisions of the Sponsor, as final and binding in all respects.  Any questions, comments, or complaints regarding the Sweepstakes must be directed to the Sponsor at the following address: [email protected].
  2. PRIZE AND APPROXIMATE RETAIL VALUE (“ARV”): The Selected Winner (defined below) will receive the following from the Sponsor (the “Prize”): One (1) trip for two (2) people to a yoga adventure in Colombia (8 days/7 nights, from February 25-March 4, 2023) from The Travel Yogi including:  (i) ground transportation between the Cartagena airport and the retreat location, (ii) double occupancy room, (iii) daily meals per the itinerary, (iv) yoga classes per the itinerary and (v) all other standard amenities included for trip participants.  The Selected Winner will receive the following from the Partners: (i) an e-commerce shopping spree provided by Eastern Mountain Sports of $200 in value per person, (ii) annual membership per person for YogaWorks Live & On-Demand online service, (iii) round trip airfare in Economy Standard class for two from YogaWorks (air only) leaving and returning from any major airport nearest winner’s home (as determined by Sponsor/Partners in their sole discretion) in the United States or Canada to Cartagena (CTG) airport in Colombia,  (iv) one (1) trip planning session with a Fathom editor, and, (v) Fathom’s Travel Anywhere (And Avoid Being A Tourist) book. By accepting the prize, Selected Winner agrees to release the Sponsor, its Partners and all of their respective  stakeholders, employees, officers, managers, agents, consultants, directors, successors and assigns (“Released Parties”) from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the promotion or for damages of any kind caused by any prize or resulting from acceptance, possession, or use/misuse of prize awarded, or while preparing for, participating in, and/or traveling to and from any prize-related activity. Prize will be awarded “as is” with no warranty or guarantee, either expressed or implied, by Sponsor or Partners.

All prize details will be determined in Sponsor’s sole discretion. The Prize is non-assignable, non-transferable, and must be accepted as awarded. No substitutions may be made. The Prize will only be awarded to the verified Selected Winner.

There will be only one winner selected for this Sweepstakes.  The Prize and Prize elements are not redeemable for cash and are not transferable. The Prize trip must be taken on the date specified by the Sponsor or the Prize will be forfeited and an alternate winner may be selected.  The Prize winner and his/her guest must travel on same itinerary and must agree to depart and return on dates specified by Sponsor/Partners, which are subject to change, or Prize will be forfeited. If any of the Prize-related activities is canceled or postponed for any reason, Sponsor reserves the right, in its sole discretion, to award the balance of the Prize or to award an alternate prize of equal or greater value in full satisfaction of the Prize award.  Released Parties, including those of the Partners as well as the Sponsor, are not responsible for travel delays, cancellations, Acts of God, pandemics, epidemics, government-mandated shutdowns, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any aspect the Prize.  If, for any reason whatsoever, the Selected Winner and/or the Selected Winner’s guest are unable to travel or participate in the Prize trip after all trip-related travel arrangements have been made, the Sponsor shall have no further obligation to the Selected Winner and/or to the guest.  Travel, accommodation and other yoga adventure terms and restrictions apply. No prize substitution will be allowed, except in the Sponsor’s discretion.  The Selected Winner and their guest must be 21 years of age or older, must travel on the same itinerary, and are responsible for obtaining and possessing all required valid photo ID and travel documents prior to and during travel, including but not limited to valid passports/visas.

In the event the Selected Winner and/or the Selected Winner’s guest engage in behavior at any point during the Prize trip that (as determined by the Sponsor in its sole discretion) is obnoxious or threatening, illegal, or that is intended to threaten or harass any other person, or that in any way disparages or adversely affects the reputation, image, and/or customer goodwill of the Sponsor, it Partners or any of the Sponsor’s or its Partners’ services, products, trademarks, service marks, or logos (collectively, “Disqualifying Behavior”), the Sponsor reserves the right to terminate the Prize trip early, and send both the Selected Winner and the guest back to their point of origin for the trip with no further obligations or compensation whatsoever to either of them (which shall result in the Selected Winner’s disqualification from the Sweepstakes and forfeiture of any (and/or all) of the Prize.  In the event Selected Winner or guest engages in Disqualifying Behavior that (as determined by the Sponsor in its sole discretion) is illegal, tortious, or subjects the Selected Winner or their guest to arrest or detention, the Sponsor shall have no obligation to pay any damages, fees, fines, judgments or other costs or expenses of any kind whatsoever incurred by the Selected Winner or their guest as a result of such Disqualifying Behavior.  Sponsor and its Partners shall have no liability for any personal injuries, death, property damage, or other damages or expenses resulting from or arising out of any travel or other event related to the Prize or any other aspect of the Selected Winner’s or their guest’s acceptance or use of the Prize.

  1. ODDS: The odds of winning depend on the number of eligible entries received.
  2. SELECTION AND NOTIFICATION OF PRIZE WINNER: Following the end of the Sweepstakes Period, the Sponsor will select the winner of the Prize (the “Selected Winner”) via a random drawing on or about October 3, 2022 from all eligible entries received during the Sweepstakes Period.  The Selected Winner will be notified via email on or about October 3, 2022.  The Selected Winner must respond and accept the Prize within ninety-six (96) hours of the time in which the notification email was sent in the manner required by the Sponsor and these Official Rules (the “Acceptance Deadline”) or an alternate winner will be selected.
  3. RIGHTS GRANTED BY ENTRANTS: By entering the Sweepstakes, each entrant understands and agrees that the Sponsor, its Partners and its licensees, successors, assigns and commercial co-venture Partners will have the right, where permitted by law, without any further notice, review or consent, to print, publish, broadcast, distribute, and use all information set forth in the entry, in any media, worldwide (including but not limited to internet and television broadcast), including, without limitation, name, image, voice, likeness, possible footage, photographs and video, voice, opinions, hometown and/or state and/or country, biographical information and/or statements about the Sweepstakes, as news, and for purposes of publicity, promotion, advertising and/or trade, throughout the universe and in perpetuity, and in any and all media now or hereafter known, without any further compensation.
  4. PRIVACY POLICY / DATA COLLECTION: All information provided by each entrant to the Sweepstakes will be subject to and treated in accordance with the Sponsor’s terms and conditions and privacy policy set forth on Sponsor’s website at https://thetravelyogi.wpengine.com/tc/. Any personally identifiable information collected during an entrant’s participation in the Sweepstakes will be collected by the Sponsor and used by the Sponsor, the Partners, and their respective affiliates, agents and marketers for purposes of the proper administration and fulfillment of the Sweepstakes as described in these Official Rules.
  5. GENERAL PRIZE CONDITIONS: The Selected Winner is responsible for all federal, provincial, state, and/or local taxes, and for any other fees or costs associated with acceptance or use of the Prizes including, but not limited to, all federal, provincial, state & and local taxes, additional ground transportation, food, and/or beverages, souvenirs, gratuities, airline luggage charges, & incidentals, upgrades, insurance, service charges and other miscellaneous travel expenses. The Selected Winner will be required to notify the Sponsor of the Prize acceptance by returning an executed and notarized prize claim document (the “Prize Claim Document”) within the Acceptance Deadline. The Selected Winner’s guest will also be required to sign and return a liability release and (where legal) publicity release prior to the Prize confirmation within the time frame established by the Sponsor once the Selected Winner has accepted the Prize. When receiving the Prize, if the Selected Winner fails to agree to terms and sign the requisite document or if the Selected Winner is not in compliance with these Official Rules, then such person shall be disqualified as the Selected Winner and at the Sponsor’s sole discretion, an alternate winner may be selected for the prize at issue. Each potential winner is subject to verification before the Prize will be awarded.
  6. GROUNDS FOR DISQUALIFICATION: The Sponsor reserves the right, in its sole and absolute discretion, to disqualify the Selected Winner for any of the following reasons: (1) failure by the Selected Winner to respond to the Sponsor’s winner notification attempt within the Acceptance Deadline; (2) the return of the Sponsor’s winner notification as undeliverable after three attempts; (3) the return of any component of the Prize as undeliverable; (4) failure to provide the Sponsor with satisfactory proof of age, identity and residency, including a failure to execute the Prize Claim Document within the specified time frame; (5) failure to validly claim the Prize within ten days after the Prize is sent; (6) any effort or attempt by the Selected Winner to tamper with the entry process or the operation of the Sweepstakes, or to disrupt or undermine the legitimate operation of the Sweepstakes and/or the Website or (7) any other failure to comply with these Official Rules.  If the Selected Winner is disqualified, then Sponsor will select an alternate winner via a subsequent random drawing from the remaining eligible entries. Notwithstanding the foregoing, any attempt to cheat the Sweepstakes, as determined at the sole and absolute discretion of the Sponsor, may result in immediate disqualification of the entrant, as well as other possible consequences, including disqualification from any and all existing and future sweepstakes.  ANY ATTEMPT BY A PERSON TO DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK ALL LEGAL AND EQUITABLE REMEDIES FROM AND AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.  The Sponsor reserves the right, at its sole and absolute discretion, to disqualify (or terminate the prize of) any individual who is found to be, or suspected of, acting in an unsportsmanlike, obscene, immoral or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person.  If the Sweepstakes is terminated due to tampering or technical difficulties prior to its expiration date, notice will be posted on the Website via a Sponsor update and/or on the site(s) where these Official Rules have been posted.
  7. ADDITIONAL TERMS: Sponsor reserves the right to modify, extend, suspend, or terminate the Sweepstakes, in whole or in part, if it determines, in its sole discretion, that the Sweepstakes is technically impaired or corrupted or that fraud or technical problems, failures, malfunctions or other unintended circumstances have impaired the integrity, administration, security, proper play, and/or feasibility of the Sweepstakes as contemplated herein. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select winners in a random drawing from all eligible, non-suspect entries unaffected by the problem. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.
  8. WAIVERS, DISCLAIMERS AND RELEASES: By participating in the Sweepstakes, entrants agree to release, discharge and hold harmless the Sweepstakes Entities, Meta Platforms, Inc. and its affiliated entities (including without limitation, Instagram) and each of their respective Released Parties, from and against any and all claims, liability, costs, losses, damages or injuries of any kind arising out of or related to entrants’ participation in the Sweepstakes and/or related to any prize (including, without limitation, losses, damages or injuries to entrant’s or any other person’s equipment or other property, or to their persons, related to participation in the Sweepstakes; or arising out of any violation of rights of publicity or privacy, or claims of defamation or portrayal in a false light; or based on any claim of infringement of intellectual property; or from any typographical, human or other error in the printing, offering, selection, operation or announcement of any Sweepstakes activity and/or prize). Without limiting the generality of the foregoing, entrants agree that the Released Parties: (A) have neither made nor will be in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, in connection with the Sweepstakes and/or with respect to prizes, including, without limitation, to any prize’s quality or fitness for a particular purpose; (B) maintain no control over the personnel, equipment or operation of any air, water or surface carrier (other than that of the Released Party), ship line, bus or limousine company, transportation company, hotel, manufacturer or other person or entity furnishing services, products or accommodations (“Suppliers”) as a part of the prizes provided in connection with the Sweepstakes; and (C) will not be responsible or liable for any injury, damage, loss, expense, accident, delay, inconvenience or other irregularity that may be caused or contributed to: (i) by the wrongful, negligent or unauthorized act or omission on the part of the Suppliers or any of their agents, servants, employees or independent contractors, (ii) by any defect in or failure of any vehicle, equipment, instrumentality, service or product that is owned, operated, furnished or otherwise used by any of those Suppliers, (iii) by the wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of the Released Parties, and (iv) by any cause, condition or event whatsoever beyond the control of the Released Parties.  Entrants agree and that the Released Parties shall have no responsibility or liability for discontinued prizes; human error; incorrect or inaccurate transcription of registration and/or account information; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, or Internet service provider utilized by the Sponsor or any of the Partners; interruption or inability to access the Website or a website of a Partner, or any online service via the Internet due to hardware or software compatibility problems; any damage to participant’s (or any third person’s) computer and/or its contents related to or resulting from any part of the Sweepstakes; any lost/delayed data transmissions, omissions, interruptions, viruses, bugs, defects; errors, typos or misprints in these Official Rules, in any Sweepstakes-related advertisements or other material and/or any other errors or malfunctions, even if caused by the negligence of the Released Parties.  Each entrant further agrees to indemnify and hold harmless Released Parties from and against any and all liability resulting or arising from the Sweepstakes and to release all rights to bring any claim, action or proceeding against the Released Parties and hereby acknowledge that the Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to a prize, including express warranties provided exclusively by a Supplier that may be sent along with a prize.  The Sponsor is not responsible for the actions of entrants in connection with the Sweepstakes, including entrants’ attempts to circumvent the Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Sweepstakes.  Under no circumstances is the Sponsor and its Released Parties responsible for the acts or omissions of any Partner or such Partner’s Released Parties and each of the Partners is not responsible for the acts or omissions of another Partner’s or such other Partner’s Released Parties, nor for the act or omission of the Sponsor or its Released Parties.
  9. DISPUTES: This Sweepstakes shall be governed by the laws of the State of California (without giving effect to any conflict of laws principles under California law).  As a condition of participating in this Sweepstakes, each entrant agrees that any and all disputes which cannot be resolved between the parties, and any and all causes of action arising out of or connected with this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court of competent jurisdiction located in Los Angeles County in the State of California. Further, in any such dispute, any and all claims, judgments and awards will be limited to actual third-party, out-of-pocket costs incurred (if any) not to exceed ten dollars ($10.00), but in no event will attorneys’ fees be awarded or recoverable and under no circumstances will any entrant be permitted to seek or obtain awards for (and each entrant hereby knowingly, expressly and irrevocably waives all rights to claim or recover) (a) punitive, incidental, special, indirect, or consequential damages and/or (b) attorneys’ fees or other expenses.
  10.
