Photography & Video Release

For good and sufficient consideration, receipt of which is hereby acknowledged, once you (“Traveler”) book a trip with The Travel Yogi (referred to as “us”), you will be deemed to have agreed to this Photography & Video Release.  Moreover, your booking, together with (a) the Traveler Terms & Conditions and (b) this Photography & Video Release will constitute a legally binding contract between you and us.  (Note:  If you book a trip for multiple people traveling together, then all travelers in that booking will be deemed to have read and agreed to the Photography & Video Release, and to be parties to this Release.)  The Traveler(s) hereby acknowledges and agrees as follows:

  1. The Travel Yogi and its parent, affiliates, licensees, successors (collectively, “The Travel Yogi”) as well as YogaWorks it’s parent, affiliates, licensees, successors and assignees (“YogaWorks”) (The Travel Yogi and YogaWorks are collective referred to as “Filming Parties”) will have the right to take still photographs (“Photos”) and/or audiovisual footage (“Footage”) featuring Traveler including, without limitation, the Traveler’s likeness and voice.
  2. The Photos and the Footage, and all of the results and proceeds of the Traveler’s services in connection therewith, including, but not limited to, all copyrights, will be owned solely and exclusively by the Filming Parties, throughout the universe and in perpetuity, free of any claims by the Traveler (or any other person or entity with respect to the Traveler). Accordingly, the Filming Parties shall have the sole and exclusive right, throughout the universe and in perpetuity, to use, distribute, publish and otherwise exploit the Photos and/or the Footage and/or any portion thereof, by any method(s) and in any and all media now or hereafter known.
  3. The Filming Parties will have the irrevocable, royalty-free right, throughout the universe and in perpetuity, to use Traveler’s name and likeness in, and in connection with, the Photos and the Footage. The Traveler expressly waives any right to review, inspect or approve the Photos or the Footage.

The Traveler hereby represents and warrants that: (a) the Traveler has the right to perform for and appear in the Photos and the Footage, (b) Traveler’s performance and appearance in the Footage and the Photos will not violate, conflict with or infringe upon the rights of any person or entity,(c) that Traveler will not receive any additional consideration for the performance or appearance in the Footage and the photos, and (c) Traveler has read and understands this document, and has the full right and capacity to grant the rights stated herein.
